A separate petition that sought to halt construction was denied by the Supreme Court in January. With all three Supreme Court proceedings now concluded, construction can continue without legal challenges affecting the city’s approval of the project.

Nearby Red Ledges residents argue that the county improperly exercised its land-use authority in approving the project, while attorneys for the Church and the county maintain that the approval was within the county’s authority under state law. The justices have not established a timetable for issuing a decision. The court previously ruled that construction could continue while the lawsuit is pending.
